For good and valuable consideration, the receipt of which is hereby acknowledged, I grant to this current film production (“PROJECT”) and/or WriterBoyFilms, LLC or its authorized representative, assigns or licensee(s) (collectively “PRODUCER”), the unrestricted right and license to record, film, photograph, tape and otherwise capture and reproduce in any manner, my image, name, stage name, voice, likeness and information about me (collectively referred to as my “Performance”) in all forms and media including composite or modified representations for all purposes, including advertising, trade, or any commercial purpose throughout the world and in perpetuity. Furthermore, Producer shall have the right and license to use any biographical material that I might furnish to it. All images and sound captured on tape or otherwise shall be referred to in this Personal Release as the “RECORDINGS".
I further agree that Producer shall (i) own all rights in the Recordings, (ii) have the right to use the Recordings, in whole or in part, in any manner or media (whether now existing or created in the future), and (iii) be entitled to use the Recordings as Producer deems appropriate, including, without limitation, for promotion and publicity purposes, in perpetuity, and in all languages, throughout the universe. "Media" for purposes of this Personal Release shall include, but not be limited to, television broadcasts and rebroadcasts, newspapers, magazines, outdoor advertising, and Internet and other electronic distribution.
My Performance in connection with the Project shall be deemed a work-made-for-hire specifically ordered or commissioned by Producer under all applicable copyright laws. Producer shall exclusively own all now known and/or hereafter existing rights of every kind throughout the universe, in perpetuity and in all languages, pertaining to such results and proceeds in and to my Performance and the Project, and all elements therein, for all now known and/or hereafter existing uses, media, and forms, including, without limitation, all copyrights.
Producer is under no obligation to use or exhibit the Recordings granted in this Agreement in any manner. I waive (i) the right to inspect or approve of any use of the Recordings, (ii) any rights to injunctive relief I may have in connection with this Personal Release, (iii) the right to revoke this Personal Release at any time in the future, and (iv) any moral rights I may have in the Recordings.
I further release and agree to hold harmless and indemnify Producer from any and all claims, demands, causes of action, damages, liabilities of any kind, and reasonable attorneys fees which may arise out of, or in connection with, the use by Producer of the Recordings. .
This Personal Release shall be governed by the laws of the State of Washington, DC, regardless of the place of its physical execution and shall be binding on my legal representatives, heirs, and assigns. I represent and warrant that I have the right, power, and authority to grant the rights set forth in this Personal Release and that it is not necessary for Production Company to pay any fees to any collective bargaining organization in connection with my services hereunder. This Personal Release represents the entire understanding in effect between the parties.
